These Terms & Conditions govern access to Aarogyama, its counselling services, wellness programs, digital platforms and related offerings. By using the Platform, you acknowledge and agree to be legally bound by these Terms.
Legal Overview
These Terms establish the rights, responsibilities, limitations and protections applicable to all users, professionals and visitors of the Aarogyama Platform. They are designed to promote a safe, professional and legally compliant environment for counselling and wellness services.
Acceptance of Terms
By accessing, browsing, registering on, booking services through, or otherwise using Aarogyama, you acknowledge that you have read, understood and agreed to be legally bound by these Terms & Conditions. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Platform and Services.
Nature of Aarogyama Services
Aarogyama is a technology-enabled wellness and counselling platform that facilitates access to independent counsellors, therapists, psychologists, coaches and wellness professionals. Aarogyama itself does not operate as a hospital, psychiatric institution, emergency response service or medical establishment unless expressly stated. Services are intended to provide emotional wellness support, counselling, guidance and psychoeducational assistance.
No Medical or Emergency Services
The Platform is not designed for medical emergencies, psychiatric emergencies, crisis intervention, suicidal ideation, self-harm situations, violent behaviour or circumstances requiring immediate medical attention. Users experiencing such situations should immediately contact emergency services, a licensed psychiatrist, the nearest hospital or an appropriate emergency healthcare provider.
Eligibility & User Obligations
Users must be at least eighteen (18) years of age and legally competent to enter into binding agreements. Users agree to provide accurate information, maintain confidentiality of account credentials, comply with applicable laws and use the Platform respectfully and responsibly. Services for minors may only be accessed with informed consent from a lawful parent or guardian.
Professional Independence
Professionals available through Aarogyama operate independently and remain solely responsible for their qualifications, licences, certifications, counselling methods, advice, professional judgement and compliance with applicable legal and ethical standards. Nothing in these Terms creates an employment, partnership, agency or joint venture relationship between Aarogyama and any professional.
Online Counselling & Technology Risks
Users acknowledge that online counselling and digital communication involve inherent limitations including internet disruptions, technical failures, security risks and communication delays. While Aarogyama employs reasonable safeguards, uninterrupted availability, privacy or technical performance cannot be guaranteed.
Bookings, Payments & Refunds
All bookings, payments, cancellations, rescheduling requests, credits and refunds shall be governed by Aarogyama's Refund & Cancellation Policy. Aarogyama reserves the right to refuse services, cancel bookings or suspend access where payments remain unpaid, disputed or subject to suspected misuse.
User Conduct
Users shall not engage in abusive, threatening, discriminatory, fraudulent, unlawful or disruptive behaviour. Users shall not harass professionals, misuse Platform resources, impersonate another individual, provide false information or interfere with Platform functionality. Violations may result in immediate suspension or termination.
Intellectual Property Rights
All content available through Aarogyama including logos, trademarks, branding, graphics, text, videos, assessments, wellness programs, website design, software, documentation and proprietary materials remain the exclusive property of Aarogyama or its licensors. Users may not reproduce, distribute, modify, reverse engineer, publicly display, commercially exploit or otherwise use such materials without prior written permission.
Session Recording & Confidentiality
Users shall not record, photograph, screen-record, reproduce, publish or distribute any counselling session, workshop, consultation or interaction without prior written consent from Aarogyama and the concerned professional. Unauthorized recording or dissemination may result in immediate termination of services and legal action. Aarogyama shall maintain reasonable confidentiality standards subject to applicable legal obligations and safety requirements.
Third-Party Services
The Platform may integrate or provide access to third-party websites, payment gateways, communication tools, hosting providers and software services. Aarogyama neither controls nor guarantees the performance, security, availability or privacy practices of such third parties. Users access such services at their own discretion and risk.
Disclaimer of Warranties
The Platform and Services are provided on an 'as available' and 'as is' basis. To the fullest extent permitted by applicable law, Aarogyama disclaims all warranties, representations and guarantees, whether express or implied, including fitness for a particular purpose, merchantability, uninterrupted availability, accuracy, reliability and suitability of Services. Counselling and wellness outcomes vary significantly between individuals and cannot be guaranteed.
Limitation of Liability
To the maximum extent permitted by law, Aarogyama, its founders, directors, employees, affiliates, consultants, contractors and representatives shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages. Aarogyama shall not be responsible for emotional distress, dissatisfaction with services, loss of opportunity, loss of profits, loss of data or any therapeutic outcomes. In all circumstances, Aarogyama's aggregate liability shall not exceed the fees paid by the user during the three months immediately preceding the relevant claim.
Indemnification
Users agree to indemnify, defend and hold harmless Aarogyama, its directors, employees, consultants, affiliates and representatives against any claims, liabilities, losses, damages, costs, penalties or legal expenses arising from misuse of the Platform, violation of these Terms, unlawful conduct, infringement of third-party rights or disputes involving professionals or other users.
Suspension & Termination
Aarogyama reserves the right to suspend, restrict or permanently terminate access to the Platform without prior notice where necessary to protect users, professionals, operational integrity, legal interests or public safety. Such termination shall not affect any accrued rights, liabilities or obligations.
Force Majeure
Aarogyama shall not be liable for delays, interruptions or failures resulting from circumstances beyond reasonable control including natural disasters, pandemics, cyberattacks, internet outages, government restrictions, labour disruptions, technical failures, power outages or other force majeure events.
Changes to Terms
Aarogyama reserves the right to amend, update or modify these Terms at any time. Updated versions shall become effective immediately upon publication on the Platform. Continued use of the Platform after publication shall constitute acceptance of the revised Terms.
Governing Law & Contact Information
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to the Platform shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
